Welcome to DockLevel (“DockLevel,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, platform, APIs, and any related services (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Use of the Services

DockLevel is not liable for loss of User Data except as required by law.

DockLevel may add, remove, or modify features as the platform evolves.
We may update or discontinue parts of the Services at our discretion.

We will attempt to notify users of material changes where practical.

4. Beta Features / Early Access

If you are using a beta, preview, or early-access version of the Services:

  • Features may be incomplete or unstable
  • We may modify or remove them at any time
  • We provide such features “as-is” without warranties

Your feedback helps improve the platform, and you allow DockLevel to use submitted feedback without restriction.

5. Fees and Payment (If Applicable)

If paid plans or usage fees apply now or in the future:

  • Prices will be displayed prior to purchase or upgrade
  • Fees are non-refundable unless required by law
  • You authorize DockLevel or its payment partners (e.g., Stripe, PayCargo, Plaid) to process charges
  • Failure to pay may result in suspension or termination of access

If you are currently on a free or early-access plan, we will notify you before charging for future services.

6. Third-Party Services & Integrations

The Services may integrate with third-party systems (e.g., carriers, CFS portals, ERPs, TMS, payment networks). Use of third-party services is subject to their own terms. DockLevel is not responsible for third-party outages, data inaccuracies, or actions.

7. Intellectual Property

All platform components—including software, code, designs, branding, and documentation—are the property of DockLevel or its licensors.

You may not copy, modify, distribute, or create derivative works without our permission.

8. Termination

We may suspend or terminate your access if:

  • You breach these Terms
  • You misuse the Services
  • We discontinue the Services

You may terminate your account at any time by contacting us.

Upon termination, your right to access the Services ends, but certain provisions (including limitations of liability and intellectual property protections) will continue to apply.

9. Disclaimers

The Services are provided “as-is” and “as available,” without warranties of any kind, including:

  • Accuracy of data
  • Availability
  • Merchantability or fitness for a particular purpose
  • Non-infringement

DockLevel does not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law:

  • DockLevel is not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability for any claim is limited to the amount you paid (if any) in the 12 months preceding the event giving rise to the claim
  • DockLevel is not responsible for delays, outages, or losses caused by third-party systems, integrations, or service providers

Some jurisdictions may not allow these limitations; in those cases, they apply only to the extent allowed.

11. Indemnification

You agree to indemnify and hold DockLevel harmless from any claims, losses, or damages arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your infringement of any third-party rights

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflicts of law. Any disputes will be handled in courts located in New Jersey, USA.

13. Changes to These Terms

We may update these Terms occasionally. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
